Professional Services - UPDATED

Professional Services Approval Form Workflow for Dell Medical when obtaining professional services (i.e. medical services) as governed by Texas Government Code Sec. 2254

  1. Dept determines the need for professional services.
    1. Professional service providers are normally licensed or certified and the scope of their services include:
      1. accounting
      2. architecture
      3. landscape architecture
      4. land surveying
      5. medicine
      6. optometry
      7. professional engineering
      8. real estate appraising
      9. professional nursing
    2. A provider of professional services may not be selected on the basis of competitive bids, but rather on basis of demonstrated competence and qualifications to perform the service and for a fair and reasonable price.
  2. At DMS this primarily relates to contracting with licensed doctors or nurses. As of May 2025, HPB 7.7.7 was updated to exempt 'Specialized Educational and Physician Services" from the competitive procurement process. When the services you are procuring fall in that scope, you do not need to fill out a noncompetitive purchase justification.
  3. Department submits a contract request through Contracts+ (formerly TCM) with support (no justification form if scope is #2).
  4. Contract workflow begins.

NOTES:

  • All agreements for professional services will be kept in Contracts Plus.
  • All agreements for professional services with a total value over the life of the agreement in excess of $50,000 will be reported to the Legislative Budget Board. Business contracts will complete the filings with the LBB.
